Article 1 – Definitions
The following definitions apply to these General Terms and Conditions:

Withdrawal Period: The period during which the consumer may exercise their right to cancel the contract.

Consumer: An individual who is not acting within the scope of their business or profession, and who enters into a distance contract with a business.

Continuous Contract: A distance contract for a series of products or services where obligations are carried out over time.

Right of Withdrawal: The option for the consumer to cancel a distance contract within the withdrawal period.

Business: An individual or legal entity offering products or services at a distance to consumers.

Distance Contract: A contract concluded between a business and a consumer via distance communication technology.

Article 3 – Scope of Application
These General Terms and Conditions apply to all offers made by the business and any contract entered into at a distance. Before finalizing a contract, these terms will be made available electronically or otherwise.

Article 4 – Offers
Offers are non-binding. Bennett & Lowe reserves the right to modify offers at any time. All offers clearly state the total cost, including shipping fees, customs duties, and additional postal or courier charges.

Article 5 – Agreement and Cancellation
An agreement is concluded when the consumer accepts the offer and meets the specified conditions. Bennett & Lowe will immediately confirm acceptance via email.

Orders can be cancelled within 24 hours of being placed by contacting support@bennettandlowe.com, and a full refund will be issued. After 24 hours, the order has already been processed by our fulfillment partner and can no longer be cancelled. Eligible items can still be returned after delivery under our Refund Policy.

Article 6 – Right of Withdrawal
The consumer has the right to withdraw from the contract within 30 days from receiving the product, without providing a reason. Returns are shipped to our overseas fulfillment warehouse. The consumer is responsible for the return shipping costs when exercising the right of withdrawal, unless the product is defective or incorrect.

Article 7 – Costs in Case of Withdrawal
Bennett & Lowe will refund payments within 14 days of receiving the returned product, provided the product is returned in its original condition. Refunds are issued to the original payment method used at checkout.

Article 8 – Customs and VAT
The customer is solely responsible for complying with all legal obligations related to the import of goods into their destination country, including but not limited to customs fees, taxes, and clearance charges.

Bennett & Lowe is not the official importer of products shipped to customers outside of the United States. The customer is responsible for ensuring compliance with local import regulations for purchased goods.

Any additional costs related to customs clearance, including administrative fees imposed by postal or courier services, are the sole responsibility of the customer.

Bennett & Lowe provides necessary shipping documents but does not guarantee that goods will comply with local import regulations. Customers are advised to check the import requirements before placing an order.

Article 9 – Payment Processing and Reporting
Payments are processed securely by third-party payment providers. Bennett & Lowe does not store full card details. In accordance with United States law, payment providers may report transaction data to the Internal Revenue Service (IRS), including through Form 1099-K. Bennett & Lowe complies with all applicable federal and state requirements related to payment processing and reporting. Applicable sales tax is charged at checkout where required by state law.

Article 10 – Compliance and Warranty
Bennett & Lowe guarantees that products are in compliance with the contract and applicable legal requirements. Complaints regarding defects must be submitted in writing within 7 days of receipt, including photographic evidence of the defect. Products must be returned in their original condition and, where possible, in their original packaging.

Article 11 – Delivery
Orders are delivered within 30 days, unless otherwise agreed. In case of delays, Bennett & Lowe will inform the consumer within 14 days from the order date.

Orders are shipped in such a way that the customer is the recipient and legally responsible for all procedures related to importation.

Bennett & Lowe ensures that products are shipped in compliance with international shipping regulations, but is not responsible for delays or issues during customs clearance.

Failure to comply with customs obligations does not constitute a valid reason for canceling an order or refunding the payment.

Article 12 – Complaint Resolution
Complaints must be submitted in writing within 7 days of detecting the issue. Bennett & Lowe will respond within 14 days. If more time is needed, Bennett & Lowe will provide an estimated resolution time.

Article 13 – Disputes
These Terms and Conditions are governed by United States law. Disputes will initially be resolved amicably. If necessary, disputes will be settled by the competent court in New York, USA.
